The federal government has just passed a new law (Law No. 14,831 of March 27, 2024) establishing the Mental Health Promoting Company Certificate. Approved by the Congress, it aims to recognize and certify companies that actively promote the mental health and well-being of their employees.
According to the recently approved law, the Mental Health Promoting Company Certificate will be awarded to companies that adopt specific measures in line with the established criteria. These measures include implementing mental health promotion programs, offering access to psychological and psychiatric support resources, as well as carrying out awareness campaigns on the importance of mental health, among others.
In addition, companies must encourage workers’ well-being by promoting a safe working environment, encouraging physical activity and leisure activities, and fostering integrative communication.
To obtain the certificate, companies need to follow clear guidelines established by the legislation, including transparency and accountability. The certificate will be awarded by a certifying commission appointed by the federal government, which will assess whether the companies’ practices comply with the guidelines.
The certificate will be valid for two years, with a new assessment required for renewal. Companies that obtain the certificate will be able to use it in their communication and promotional materials to highlight their commitment to mental health and the well-being of workers.
However, failure to comply with the established guidelines could result in the certificate being revoked. The procedures for granting, reviewing and renewing the certificate will be detailed in a regulation to be issued by the federal government.
The new law, which is already in force, reflects the growing recognition of the importance of mental health in the workplace and seeks to encourage a corporate culture that prioritizes caring for people. The federal government will also be able to promote advertising campaigns to encourage companies to adopt the Mental Health Promoting Company Certificate.
